חנינה

חנינה היא צעד שבו הגוף המוסמך (על-פי רוב ראש מדינה, דהיינו נשיא או מלך) מוחל לאדם שנאשם או הורשע בפלילים ומבטל בכך כל הליך משפטי רלוונטי, בין של חקירה, משפט או מאסר. בדרך כלל, החנינה מאפשרת לאסיר לצאת מהכלא, אך לעתים היא כוללת רק הפחתה במידת העונש. לעתים, החנינה כוללת לא רק ביטולו של עונש, אלא אף את ביטולה של העבירה ומחיקתה מהרישום הפלילי. על-פי רוב, סמכותו של ראש המדינה לתת חנינה היא מוחלטת, סופית, ולא נתונה לערעור. מסיבה זו, במדינות רבות מגבילים אותה על ידי כך שמחייבים כתנאי נוסף גם את הסכמתה של ועדה מיוחדת או של שר המשפטים (או שניהם). במדינות פדרטיביות, הנשיא נותן חנינה למי שעברו על חוקים פדרליים ואילו המושלים נותנים חנינה על כל פשע אחר. חנינה המונית נקראת אמניסטיה (Amnesty).
