התיישנות כמונח משפטי, מסווגת כחלק מהמשפט הפרוצדורלי, והיא מתארת מצב לפיו על אף שלאדם עומדת עילת תביעה כלפי אחר, הדין מקים מניעה - מהותית או דיונית - מפני הבאתה לבירור בפני בית המשפט, משום שחלף זמן רב מדי מיום שקמה עילת התביעה ועד להגשת התביעה.
