(ש"ע) הרתעה

שייכת לקבוצת המטרות האינסטרומנטליות של דיני הנזיקין (יחד עם הצדק החלוקתי), הרואות בדיני הנזיקין כלי להשגת מטרה חברתית-כלכלית עליונה יותר. לפי מטרה זו, דיני הנזיקין נועדו ליצור הרתעה יעילה שתמנע או תצמצם הישנות של עוולות בעתיד. כדי שההרתעה תהיה אפקטיבית, עליה להיות פרופורציונלית לנזק. ההרתעה מתמקדת במעוולים הפוטנציאליים ופחות בניזוק.

שתי גישות הרתעתיות בדיני הנזיקין:
1.  הגישה של קלברזי: "מונע הנזק הזול" -  האחריות הנזיקית תוטל על הגורם שיכול למנוע את הנזק במינימום עלות, בלי קשר לאשמתו. קלברזי דוגל במשטר של אחריות מוחלטת ולכן האחריות יכולה להיות מוטלת דווקא על הניזוק, אם הוא יכול היה למנוע את הנזק במינימום עלות.
