משפט הוא הליך שבמסגרתו מתבררת תביעה בפני בית משפט או בית דין. הליך זה מתקיים כאשר צד אחד של ההליך הנקרא תובע, מחליט להגיש תביעה נגד הצד השני של ההליך הנקרא נתבע, בשל סיבות שונות. המשפט מתברר בפני שופט יחיד, הרכב של שופטים אחדים או שופט וחבר מושבעים. לעתים קרובות, הצדדים מיוצגים על ידי עו"ד או באי כוחם, אשר עורכים את טענות הצדדים ומציגים אותם בשפה משפטית על פי המשפט הפרוצדורלי. ההכרעה במשפט ניתנת בסיומו בפסק דין. פסק הדין תקף כלפי הצדדים, ובמקרים מסוימים אף כלפי כולי עלמא, על פי שיטות משפט שונות. במקרה בו אחד מהצדדים אינו מקיים את פסק הדין שנגזר, לעתים ניתן לפנות להוצאה לפועל. במקרה של משפט פלילי באה קודם הכרעת דין (הרשעה או זיכוי) ובמקרה של הרשעה מתווסף אליה לאחר מכן גזר הדין שבו נקבע עונשו של הנאשם.

ישנן שתי שיטות משפט מרכזיות: 1) שיטת המשפט האדבסרית אשר באופן עקרוני נוהגת במדינות המשפט המקובל. 2) שיטת המשפט האינקוויזטורית אשר נוהגת בארצות המשפט הקונטיננטלי.
